Auto Insurance Claims: POLICE REPORT NOT SUFFICIENT???, claims advice, accident liability

HAD AN ACCIDENT 7-8-11, REAR ENDED BY ANOTHER PERSON. POLICE CITED DRIVER FOR FAILURE TO CONTROL SPEED, AND NO DRIVERS LISC. OTHER DRIVER ALSO GAVE STATEMENT TO OFFICER AT SCENE STATEING HE TOOK HIS EYES OFF THE ROAD, WHEN HE LOOKED UP HE HAD NO TIME TO STOP BEFORE REAR ENDING MY VEHICLE. HIS INS. COMPANY HAS BEEN UNABLE TO GET HIM ON THE PHONE TO GET A STATEMENT, IT HAS BEEN OVER 2 WEEKS NOW, AND IM WITH OUT A CAR. I ASKED THE ASSIGNED ADJUSTER IF THE POLICE REPORT IS SUFFICIENT AND SHE SAID NO, IT IS A "NON-STANDARD" POLICY...ARE THEY BLOWING SMOKE HERE? WHATS MY NEXT STEP, ANY HELP WOULD BE AWESOME. THANKS

 Hello Steven,

Yes, they are "blowing smoke".  Insurance polices require cooperation.  That means their driver is required to cooperate with them.  And, in good faith insurance claim investigations, the insurance company should talk to their insured for the insured's "side".

However ...

If the insured is refusing to cooperate, they cannot take that out on an innocent party.  They have more than enough information to make a liability decision without talking to their own insured.  Not only do they have the police report, more importantly they have, at least, your vehicle which supports that report.

Non standard policy?  That's bogus.  Just because they wrote a high risk driver does not mean they don't have to pay those claims.  Imagine the precedant that would set!  And by the way, they owe you for your damages and also for a rental car for as long as your car is under repair.
