Auto Insurance Claims: Can I send a letter to a tortfeasor, return receipt, tortfeasor


Question
I was in a rear end collision and the insurance offered policy limits 25,000. My claim is much higher. Can I send a letter or call the tortfeasor and ask them if there is any other insurance available. Like separate policy. If not why?

While I am not an attorney and cannot provide you legal advice my answer is yes, you, as the victim of the the other's negligence can make contact with them and their insurer if desired. It is no different than if they had no insurance in the first place.

If it were I, I would undertake all communications in these regards in writing only as to avoid any miscommunications and/or misunderstandings. I would send all correspondence Certified, Return Receipt Requested to document receipt.
