Mazda Repair: 2008 mazda cx-9 AWD, rear drive shaft, shaft assembly

I've owned this car for about 2 months and it has been in shop for over 20 days.  Car makes an unbelievably loud banging noise... like baseball bat hitting underside of vehicle. They finally think they found the problem as bad carrier bearing.  Can't get the part though so my brand new car sits at the dealer day after day!!!  Should I be concerned about damage that was done (this sound was really loud) and will repair get my vehicle back to "like-new" (less than 2000 miles car)?  Or... should pursue lemon-law?  And advice?

My system shows the Rear Drive Shaft Assembly which appears to include the carrier support.  P/N KG03-25-100D.  $992.  The item is on nationwide backorder until August 18th.  Considering you have already waited 20 days and there may still be "no" guarantee that Mazda will fill the backorder on 8/18 you may want to consider an aggressive approach under the "lemon" law issue if your state has one citing "reasonable" time frame as the angle.



A loud banging noise under a new car should be an easy one to locate and should not take this much time.  Sounds like quality was not "job one" on this one.  Considering Mazda can roll out in excess of 100 cars per day from their Japan manufacturing plants this dealer should be able to address this issue in quicker than 20 days.  Tell me you are in a loaner car at least.  

I'm not a legal expert and laws vary from state to state but, if your "new" car has an issue that cannot be resolved in a "reasonable" time frame then I would; document everything. The first time you heard it, the first time you notified them, the first time they looked at it and every person you spoke with, the dates and the times from day one until this matter gets resolved.  Contact legal counsel for a few bucks and protect yourself now in case this does not settle in a manner that makes you happy.

From a mechanical position.  Parts fail, they like the car are man made.  If in fact this is a failed part or possibly just an installed item that was not fitted correctly then the matter is as simple as removing the old and replacing it with the new.  If so then there should be no real cause to believe you have a "lemon", nor any cause to think you will have other issues.  Mazda does make good vehicles and normally goes out of there way to see to it the customer is taken car of however they (Mazda) have to know of the issue.  The dealer on the other hand...is thinking dollars and cents.  Pursue them every day until you get resolution, if you are not satisfied by one person speak to another, document every call/visit and retain counsel so you have a legal angle should it become necessary.  Your car should be in a service bay everyday until it is repaired not parked in a lot being forgotten about and it is up to you to aggravate that dealership staff daily.
