Motorcycle Repair: Crankcase breather leaking oil, crankcase breather, top screws

Hello,
I have a 2001 Indian Chief, S&S engine, 88 cu in.  The bike has been sitting for awhile and the last couple of times I have started it up it spills oil out of the crankcase breather filter.  Is this just from the bike sitting and a build up of oil in the crankcase?  Or is this a major problem with the blow by and the rings not being seated properly?

Yes, usually just from sitting, and buildup in crankcase of oil.  If it happens all the time you have a leaking oil pump check ball.  Not the relief valve, the check ball.  Pop off the top screws on the oil pump and check the seats.  Could also be a worn check ball spring or dirty ball seat.
