Motorcycle Repair: oil in air filter, breather tube, oil breather

I have a 2004 vucan kaw and my question is besides to much oil in the engine could a really sever angle of the bike or a lay down cause oil in the oil filter?

Dave, maybe you didn't notice I'm a Harley mechanic.  Did you mean "oil in the AIR filter"?  On HD's oil in the air filter is caused by the breather.  There is a breather tube that is routed to the air filter for crankcase or top end oil vapors to be sucked into the motor and burned off.  This is for emissions requirements.  You can reroute the oil breather tube to the bottom of the bike and put a little "breather filter" on it but that is technically illegal.  And yes, overfilling or oil pump return problems can cause breather oil problems.
