Towing Issues: Car towed, broken gear shifter, mercury marquis, tow truck driver

My 1993 Mercury Marquis was repoed (Title Loan)I had it pulled forward in my driveway, upon reclaiming my car the next day at the Insurance Auto Impound I find that my gear shifter is like on the seat.  contact the tow driver and he claims it was already broken. FYI He took the car in the middle of the night with no keys. At the impound we hand over our keys and after a few minutes we hear over the radio that they can't bring the car around because the shifter is broken. Long story short they put the key in the ignition, jammed a screwdriver in the steering column. The key won't come out and the car only goes from neutral to drive. What did the tow truck driver do to my vehicle? Whose liable for repairs? I've taken pictures and made a police report. A couple of employees at the impound stated that this particular tow company brings cars in all the time with the same problems.

Wow, repo a 1993 mercury and it sounds like they tried to pop the column and get it to start or shift out of gear. (I used to call them "north Portland keys" when I worked in Oregon)

Now it sounds like the tow company is responsible to me, and the finance company should care about how their vehicles are being treated.
I doubt that the Insurance yard is involved in damaging the vehicle and if they did do it, I can also see them trying to pass this off to someone else. Always happens and the tow company always seems to get blamed.

Documentation will be the key here, and you always have the right to go to small claims court and see who the judge says is responsible.
