Towing Issues: Towing Damages, small claims court, communication attempts

My car was towed twice from the same apartment complex where my mother lives. Both times my error and I paid what I owed. However when I went to pick up my car the 2nd time it was towed my tire was knocked off the rim, it is not flat, just off the rim. I also had a few scratches one on my rearview mirror and my bumper. I called the police who told me to take them to small claims court. The damages were reported to the tow company on a form they gave me to fill out and I have my copy. I have made several attempts to contact them but the supervisor is never in. I want to move forward with filing the small claim but I wanted to make sure it is appropriate? What do you think?

Well if you are not able to contact the tow company via phone, you can always try sending them a "certified, return receipt requested" letter detailing the problem, the damages, and repair costs and ask them to respond and repair the damages.

What this also does is documents the communication attempts and or lack of response if you do go to small claims court.

If they do not respond or solve the problem then take and go to court and file, as they will get notified of the case. That will get them to move I bet.
