Towing Issues: Illegal tow?, untold hardship, course computers

My car was towed for unpaid parking fees on 9/19/10. I went to redeem the car on 9/20.  On 10/05 I came back to find my car missing. Call the 311 in NYC only to find that the car was towed for the same fees that I had paid two weeks ago by the same Marshall. Is this illegal? Can I bring the marshall or the city to court since this has caused me untold hardship etc?

Well remember that HUMAN'S were involved and humans make mistakes.

And of course computers were most likely involved and human's put information into and take information out of them. Mistakes happen.

Now that being said, it sounds like you are a victim of a mistake.
Now as to taking the Marshall or city to court. I guess you can, but at times they have immunity at times on certain things. And this might be one of them.

But I do not know a lot of the issue, and you will be the one who can decide if the effort is worth the hassle.
But I am thinking that the City might refund any towing fees you had to pay the second time, or the fine if you had to pay.

But if you go to court, make sure you have all your receipts and documentation. It might work out if you do wind up in court.
