Towing Issues: Illegal towing?, small claims court, vehicle owner

So, my mother accidentally parked her car in the wrong parking spot in our apartment complex. instead of the 38 she parked in the 36 parking spot. Our next door neighbor knocked on our door asking if it was our car that was being towed. We checked it out and it was. By the time we got there our car was already adjusted and ready to be taken off.

Now my question is if that was an illegal tow because we were not notified in time that our car was going to be towed if we did not move it. The owner of the complex told us he had be knocking on everyone's door trying to find the owner for more than an hour. but coincidentally we never had anyone come to our door to notify us. The only way we knew is through our neighbor who was kind enough to let us know.

Was it an illegal tow? Can we get our money back?

Illegal tow?  not really as the vehicle was parked illegally.

Now as to the manager - owner knocking on doors trying to find the vehicle owner that is more a courtesy then a requirement.

How far and how long should they look. One building, one block, one mile, one floor?

Reason I say that is that any effort taken to find the owner will never be enough if the vehicle was towed. But if they did find the owner of the vehicle than did they go far enough first or did they find you at the end of an hour searching.

Now as to getting the money back, it would all depend on the state you are in, as each state and many cities have regulations which would have to be followed before the tow.
And since you did not mention where it happened, I can not help by pointing to specific areas of the laws.

You have the rights to go to Small Claims Court to contest this, but you will have to have good evidence to try and win.
