Towing Issues: Towed in spot with no meter, small claims court, clifton ohio

QUESTION: So I was in Clifton, Ohio. Outside of Cincinnati, Clifton is the town in which
the university of cincinnati is. There is a natural foods store with parking
behind it, one section being metered, then another completely separate with
huge sign saying permit only. I parked in the row of metered spots. Problem
is, my spot had no meter, I'm not sure if it was recently damaged etc, but
there was just nothing there, so I didn't pay because I couldn't. Come back
hours later to my car being gone. Do I have a small claims case here?

ANSWER: and just who did authorize the tow?

That will be the case here. If the police ordered the tow for illegal parking or non payment of fee's then you might have some kind of a case. But then again, your case would depend on evidence and I am going to bet that you have no proof that there was no meter.

And do not forget that sometimes the new meters take care of 2 or 3 spaces. Could it possibly be one of those cases.

Now as to small claims court you always have the rights to go there and try to win. But remember that evidence wins the case and that will be the key there.

QUESTION: I actually do have proof of there being no meter (cell phone pic) and can
also confirm that the meter next to it wasn't one that handles more than
one spot. Does this help?

well a picture does help a lot when you go to court.

I can not however tell you how the judge would rule as that is the key part here.
Evidence is the key and you have some if not all of it, I am just answering given the information provided.
