Towing Issues: a uestion on towing regulations?, craftsman tools, medicine bank

Question
I live in east county, san diego ca. this question has to do with tow yards in
san die, ca.  we use to be able to get our personal property out of a truck or
car. the police would have it towed and there is say a thirty day hold because
it was not registered.  the tow yards here have made their own policy that if
you do not have current registration they will not let you get your personal
belongings. this seemed a bit far fetched to me, but maybe a law changed.
can you help me with this one. thanks madell

Answer
Well I really am going to generalize the answer here as it does have several different issues in this question.

First of all, not registered means that it is an illegal vehicle and according to the police and DMV, noone owns it...

So you want to get property out of the vehicle, which you claim is yours, but how do you prove that you are entitled to get that property or that it is yours???

Yes medicine, bank records and such are easy to prove that they are yours. But that bag of diamonds under the seat, the 6,000 dollars of Snap On and Craftsman tools does not have your name on them.

Personal belongings is one of those generalized statements where you have proof that you are "legally entitled to possession of it"

Its the same LEGALLY ENTITLED, which is also preventing you from getting the belongings...

Do you want anyone who says that they are the owners to be able to just walk in and say it is theirs???

Remember that the tow company is also trying to protect the vehicle and property.
