Towing Issues: tow damage, kia sedona, tow driver

Question
Short story(maybe). Had recently had transmission rebuilt, just getting my '02 Kia Sedona, SoCal,back from the mechanic on a Monday evening, Tuesday took husband to work (van ran fine). Evening went to pick husband up and on the way home AT relay went out. Got the van home, called our transmission guy. He told us not to drive the van any where and get it towed to the shop. Wednesday, got the use of mothers AAA. Tow driver got to my house, I then moved the van in position for him to get it up on the flatbed. He then gets in and drives it on, in the process, bottoms out and continues. At the time, I was 'ok'. I continued to the transmission shop, while he showed up about 1/2 hour later to the shop. When he drove it off the bed and parked it in a parking stall, I asked if thats all I needed he said yes and left.
I was finishing up with my transmission guy and turned to look at the van as we were talking and saw the radiator leaking. Damage to my radiator. We have never had a radiator issue with this van the two years we have owned it.
The transmission shop had the vehicle for 2 weeks, no leaks. Again had the vehicle for 2 days more, no leaks.

Questions: Is the towing company responsible? Are they suppose to do an inspection of the vehicle before loading on truck? If so, should I have been given a copy?

Answer
Well you have described what most tow companies do when using flatbeds. They tend to drive the vehicle on and off and due to the angle of the bed they tend to rub.

And everyone thinks that flatbed towing is damage free. In reality it causes more damage than a regular tow truck does most of the time.

Now as to the damage claim, it sure sounds like you have a valid claim against the tow company. Contact them and have them check out the damage and see if they will stand up and take responsibility. If they do not then you have to start with other places.

You mentioned AAA, and they do investigate damage and will help you in most cases getting the damage repaired. But sometimes it takes small claims court to solve the issues.

Be nice, civil and keep great notes. Take lots of pictures, get statements from the repair shop and you most likely will get ahead and have the issue resolved.
