Towing Issues: Towing on private property, puc office, small claims court

Question
I and several other cars were parked at a strip mall on Sat 7/24.  The store were closed. Quality towing towed the vehicle.  The notice to remove vehicle was in a obscured place.  I did pay the $279.25 to pick up my car?  I asked them who authorized and I was told the property manager.  I spoke with the property manager, leasing agent and owner and all informed me that they did not call to have any vehicles towed at that location.  I have asked Quality towing to please send me a copy of the picture they took where the vehicle was parked, the time they notified the police and also the contract stating that they are able to pick up vehicles at will.  I was told by Shelita she is unsure if she is able to provide this information to me.  My question is it legal for them to do that?  Is it legal for them not to give change or except credit cards.  I am just trying to find my rights. This is in las vegas so I am not sure if you are able to help

Answer
Well I am not sure if they "LEGALLY" have to provide you with the photos or copies of the contract, but if they were taken to court (such as Small Claims Court) then they would have to produce evidence to support that it was a legally authorized tow.

It does sound like there might be an issue here if the property management does not know about the vehicles being towed, but then again sometimes the management firms change and no one notifies the tow company of the change and cancels the contracts.

Or one of the stores has a contract to have vehicles removed and the the tow company followed that contact or was a bit aggressive.

I know "OF" Quality towing and they have a fairly good reputation in the towing industry, but of course there can be a driver who might of been a bit aggressive or just plain wrong. It does happen.

Dig deep in here and you will find some of your answers, as this is the Nevada PUC office regulations on tow companies in here.

I do not know if Las Vegas has additional requirements for signs, but it might, you might have to check with the city.

Cash only is very common in the towing industry as it is easy to stop payment on checks, credit cards, debit cards, money orders, travelers checks, and the like. But you can not stop payment on cash.

Not making change, well that does happen at times, and there are some reasons from time to time, but most places I have worked at, the tow company will try to get the change or even in some cases mail you back the change in a check.

Hope this helps
