Towing Issues: Are Tow Trucks exempt, tow truck driver, tow companies

Question
New Jersey law said  children under 80 pounds must be in car seat  Question is : member is broken down on the side of road needs to be towed and has a infant or child  can the tow truck driver place them in  his truck. or is that a insurance company  issue..

Answer
there are sometimes waivers in laws for Emergencies and unfortunately I am not able to find the laws in New Jersey where they would be exempt. BUT the laws do generally require that all the people in the front seat of a vehicle be secured by seatbelts.

Now as you know, insurance companies do dictate the operations of tow companies a lot and they might have a policy rider that requires car seats, or even rules that no car seats are to be in vehicles.

I hate to say that I could not find specific rules. You might check with DMV and see what they say.
