Towing Issues: i was a towed guest, guest question, sign ordinances

QUESTION: i was visiting a friend in valrico fl. he lives in a town home were you are allowed 2 cars one. I went to visit him and the visitor parking was completely full so i parked in front of his home. We had just got there after eating at chilis and it was 1am. I was in side for no less than 20 minutes and came out the door and i saw my car being towed. I talked to the owner and he said you should no better then to park in the street i said where is this posted and he would not answer me. My question is if there is no guest parking and not sufficient or proper signage does he have the right to still tow my car.

ANSWER: If the vehicle was improperly parked (regardless of the situation) and was in violation with the terms and conditions of parking on the property, sure it will get towed by the authorized enforcement contractor. Most town home owner's belong to a home owner's association and have many rules and regulations which must be followed.

QUESTION: yes i do agree to an improperly parked vehicle being towed, but there are no regulations posted for  towing an im properly parked vehicle for this subdivision. In other words there are no signs stating that improperly parked vehicles will be towed. my question is without proper notification or posting of a tow away zone can my vehicle still be towed.

Most HOA's have the R%26R's stated in the contract for home owner's given notice of such parking enforcement. Some HOA's have sign ordinances within the community which excludes sign postings but must be clearly written and expressed in the HOA's contract. If this is the case then the home owner, your friend should have informed you that the vehicle couldn't park there.

Also, depending how the vehicle was parked could impede traffic flow, especially emergency vehicles, which could be a violation in the R%26R's.
