Towing Issues: Towing without verifying registration, tow company, expired registration

Question
I live in Albuquerque, NM and when I got home from Church today, my truck was gone. We found out it was towed because of expired registration. I previously registered my vehicle online and had not received the tags yet. I live in an apartment complex and the towing company told me that were told to tow it and it is private property, so they can do that.  My question is, can a towing company tow a vehicle without verifying the registration? If they would have run the plates, they would have seen that the vehicle was registered.

Answer
So you think that the tow company or the apartment should have the same ability to run license plates and get other information instantly.

Now as you said in the question, you were towed from your apartment and you called it "private property"  Well sad to say that your apartment parking space is not private property as you do not own it. It is rental property, subject to rules and regulations as spelled out in your rental contact.

And if they say that "un registered" or unlicensed vehicles are illegal and subject to towing then they as the property owner have the rights to do so.

That is also why there are many rules regarding inoperative vehicles or working on vehicles in contracts.

Its a quality of life issue that they try to keep. After all they want a nice looking complex and you want to live in a place where there is not a lot of trash, abandoned vehicles and the like.

Now I also have to say that the tow company in 99% of the cases only responds to calls from the property management to remove vehicles. In some cases there are contracts where the tow company can cruise the property looking for violations. But that is not always a common practice.

Hope this helps shed a light on the issue.
