Towing Issues: towing from business lot, tow company, other vehicles

I had a friend of mine ask me questions regarding towing his truck off a Kmart parking lot. He had his truck parked away from other vehicles, cause he had it loaded with firewood that he sells, and displays a sign "Firewood" with phone number. After shopping in the store for a few hours, he finds his truck is gone. He recovered it thru the police couple hours later, yet there is no paperwork, no phone/manager requests to have the truck removed. Apparently, just a random call. Store manager says he didn't call, police don't have a name and number of the requesters, just the name of the tow company, and they dont have any name(s) for follow up, nor did they supply a copy of the ticket when they retreved their truck. How is this possible?

If law enforcement did not request that the vehicle be towed and the Manager of the store did not authorize the tow (if it was on their property) then someone had to authorize the tow for the vehicle. The towing company is responsible and in most states is required to have a signed authorization (depending on the state you are in) to tow the vehicle. I would contact the towing company and follow it up in writing, requesting the information on who authorized the tow. When you say he recovered it through the police, did they find the vehicle or did someone notify them that they towed the vehicle? If they cannot provide the information for who had the vehicle towed they are either lying or have towed the vehicle without authorization and I would pursue it.
