Towing Issues: Broken Down Car Towed From Goodyear, traffic section, code of alabama

QUESTION: I was on my way to school to study at the library, when my car broke down on the interstate.  Luckily my roommate was able to come help me figure out that it was a hose on my radiator that busted.  He helped me get the car off the interstate, to the next exit.  Immediately off the exit my car was overheating so bad that I had to pull over.  I pulled into a Goodyear service location,left my car there, and went to school.  I came back and my car had been towed. Next morning I looked up this, **Code of Alabama - Title 32: Motor Vehicles And Traffic - Section 32-13-1 - "Abandoned motor vehicle" defined; posted notice**, in there it says I have seven days if my car is inoperable.  I went to their office the next day and they said they would give me 75 dollars from the 125 for the towing.  I said no thank you.  Is this an admission of guilt?  Am I even legally right in this situation?  Thank you for your time.

ANSWER: Where was your vehicle parked at the Goodyear? It is true that there are time restrictions on towing but, if it is on private property, which is what the Goodyear location is then they have the right to have it removed. Did you put a note on it or tell anyone at Goodyear? Also, which Goodyear location was it?

QUESTION: It was parked in the parking lot, it was a small parking lot, I asked a technician if he would tell them that my car going to stay here and not to tow it, he said "they will tow it but I will tell them".  I did not think they would tow it after I asked him not to.  Goodyear Automotive Center 3255 Airport Blvd Mobile, AL 36606.

It's not right, but if someone told you they would tow it then you should have talked to the manager. They do have the right to remove it from private property without posting a notice. If they offered you a part of the towing fee, I would take it. It's not right or fair but they are within their rights.
