Towing Issues: towing responsiblity, better business bureau, drive wheels

Question
my daughter had her car towed for parking illegally, when she picked up the car she was told to pay and sign the form. After leaving the towing company lot she noticed a vibration in the rear.
Brought the car to Toyota dealer was told that the transmission bearing have been stripped, due to towing it from the front (its an all wheel drive matrix) towing company was called several time to see what they would offer to do, I was basically told its not there problem/fault so get lost and don't call again.
What should I do to get these guys to own up. There receipt states the car was front towed but also say that by signing she agrees the car is ok and not to hold them liable for any damage.
This damage is not viable so does that hold up? How should I proceed?  Thank you

Answer
You cannot tow an AWD vehicle with the drive wheels on the ground, any of them. If the towing company did not use a dolly or flat bed then they were not following proper towing procedures and they are responsible for any damage. I would recommend obtaining a copy of the service order from the dealership and contacting them again. If they refuse to cooperate then I would not hesitate to contact an attorney. You can also contact the Better Business Bureau and AAA if they are members and do any towing for them. The BBB will handle a complaint regardless if they are a member. You can also post a thread on ripoffreport.com it seems to generate some results. As for the form she signed it's not worth the paper it's written on. Any court should recognize that you will not be able to determine if there is a mechanical issue with your vehicle from simply looking at it. If you need anything else just let me know.
