Towing Issues: Towing indv. parked in handicap asile & spaces, mental handicaps, alabama zip code


Question

Two of the self center
we live in a HUD subsidized apt facility for persons over the age of 62 or individuals with physical/mental handicaps. Two of the residents are amputees with wheel chair lift vans. Others keep parking in the clearly striped aisle between the two vans also indv. without placards or handicap license plates park in these van accessible spaces. The parking lot has public access yet police state mgmt must call to have cars fined or towed they(police)will not do it for handicapped indv. calling to request. Cannot the person being blocked from using their van call to have illegal cars towed? Cannot the indv. parking in van accessible spaces illegally be towed via disabled person needing space making a call?  We live in Birmingham, Alabama Zip code 35210 This is a daily problem not sporadic. Well, Handicapped issues have many factors in them which make towing from them hard to follow legally.

First of all there are state laws, and then there are federal laws which apply.

Now Alabama has some laws regarding towing from private property and the important section is below.

Now as to you calling for the tow truck, or reporting it to the police.  I would not want to be the person authorizing the tow, so its best to report the violation to the police so they can enforce the laws.  As to the police not wanting you to report the violation, I think that they are trying to keep the amount of calls to them about this down, but they are supposed to respond to all calls of violations.

Now I am not sure what it would take to get the issue resolved by the police, but remember that there are always "higher ups" who might not know what is happening.  The power of the press is also something that can help at times. News loves to get onto police for not doing the job correctly.

Now I looked for specific laws regarding handicapped parking in the ALABAMA codes, but could not find them.
