Towing Issues: forgot to put up handicap placard, handicap parking sign, handicap parking space

I parked in a handicap parking space and forgot to put my placard on the review mirror. I have a placard registered to that vehicle. My vehicle was towed (no ticket given). The handicap parking did not indicate that the vehicle would be towed or indicated any fine for parking in that space, it only had the handicap parking sign. Can they tow the vehicle if the sign does not indicate that parking there will result in towing or a fine? And since I had the placard in the vehicle and it is registered to that same vehicle, can I fight the towing charges?

Well unfortunately the answer is you did get towed for not following the rules of the space which are spelled out in the drivers license manuals and also on the paperwork for your permit.

Now I am going to guess that the permit was "over the visor" or "in the glovebox" and as such was not able to be seen.

I guess that what you are asking, is why did someone "NOT RUN THE LICENSE PLATE" and see if you were handicapped ? In a nutshell, a lot of places do not have the ability or the legal rights to check and run your license places. Only the police can do that and they have certain restrictions on that even.


Well I really hate to say it, but there is so much "ABUSE" with handicapped permits - placards where it becomes impossible to tell if the vehicle displaying it is even legally using it.

Lets say you had wrecked your vehicle and borrowed your neighbors vehicle, you went to Wal-Mart and parked in the handicapped spaces and went shopping. BUT YOU DID NOT DISPLAY the permit.  Can I as a tow truck driver or even a police office tell if the vehicle has a permit ?
NOPE, no one can at that point.

Now as to fighting the tow fees, well you always have that right in small claims court, but the fact that it was not displayed will run heavy against you. People are not mind readers and my X-RAY VISION is a bit rusty when used around cars.

It would most likely be a waste of time and money to fight it but that is up to you to decide.

But I kind of have a joke saying about people who do not display the required permits - placards which I tell and it kind of works the same way.

"HOW can I be out of money, I still have blank checks left to fill out"
