Towing Issues: Friends Car Towed From My Apartment, tow truck company, california dmv

QUESTION: I gave a friend of mine a ride to the airport and he had left his car at my apartment.  I had moved his car periodically, however, his car was towed from the Guest Parking Lot within a few weeks.  When I contacted my Apartment Manager, she indicated that it had been towed as they thought the car had been abandoned and gave me the telephone number of the Tow Truck Company that towed his car.  When I contacted them, they indicated that they had his car over 30-days and; therefore, sold it.  I know for a fact that they did not have possession of that car for 30-days.  What can I do?

ANSWER: Well it depends on state lien laws on how fast vehicles can be sold.

Some states have a lien where the value of the vehicle determines how fact the lien process works.

California and Oregon come to mind right off the top of my head.


Since you did not tell me that vital piece of information (the location) I can not point you in the right direction.   Check with your state DMV and see what the lien laws are for towed vehicles and you will get the answers there.

You are absolutely right!  I didn't advise you of the State where this took place.  It is California. I looked in my California DMV book and I didn't have any luck finding any information about California lien laws.  

Is there anything we can do?
