Towing Issues: car towed, small claims court, naples area

Naples, florida. Towing company says that my car was parked at the guest parquing for 4 days and all they have to prove it is a LOG; where you can write anything. My car was parked for two nights!! How and where can I go to file a dispute against them and how can they lie and steal people's money like this!! Can they do this???

Well you are correct that a "written log" can be bad or falsified  but it also works great...

But a lot of people do not really consider time or days correctly when dealing with towing and parking issues.

I am going to guess that you arrived and parked on Friday evening,  

That is one day  (Friday) and you will have Friday night
Saturday the vehicle is there all day and night,  That is day 2 and night 2.  

Sunday the vehicle is there during the day and lets say you leave at 4 PM. That would be day 3


Tow companies tend to work on "calendar days" not 24 hour  days like some people think..  
But also at times the storage fees charged by tow companies for impounded vehicles are based on 24 hour periods...

Yes it does get confusing...


As to where to dispute the towing, well there is always the SMALL CLAIMS COURT if you feel that you were wronged.  Yes that costs money and takes time, but you get heard by a judge in most cases and it is like a trial...  You get to present your evidence and the tow company or the property management (or both) get to defend themselves and all that...


Now I have heard lots of stories about aggressive tow companies in the Naples area and while that is good news on your part, remember that the press only reports on stories which they can "SELL THE STORY" on.  Remember the saying about newspapers, "if it bleeds it leads"
They only report what is normally bad news.


You can check with the local police department to see if there is a city law or regulation which governs towing vehicles from private property, and I know that there are also state laws on that issue.
