Towing Issues: is my car towed unlawfully, police towed my car, best bet

DMV suspended my license because they thought i did not have insurance in an accident last year september. I didn't know this after I was caught talking on cell phone while driving this week. The police towed my car and gave me ticket for driving without license. I had to pay $425 to get my towed vehicle back and pay the ticket.

I should never have been suspended in the first place. First of all, I had insurance and always did (i showed dmv the paperwork and they validated my license). DMV suspended me because they thought i didn have insurance because the other party filed a report and i did not. However, i was not obligated to file a report to DMV on that accident (the damage was not over $750, no one was injured and no death is involved).

After I got my license validated, i went to the police hearing for towing my vehicle. Police said it wasn;t their fault and my best bet is to talk to DMV or sue them for my $425 back.

Should the police take care of the issue, that is give me back my money, or should DMV?

Before any civil action is taken I suggest speaking to a DMV manager first and express your claim. They may help but don't be surprised if you get the cold shoulder. The chances of being reimbursed for the tow are slim to none. You could try civil action afterwards and good luck. The police are correct as it not being their problem or responsibility.
