Towing Issues: car towed, car cause, tow company

In the state of NM can a tow company hold a vehicle for money owed. Some guys took my daughters car and put it in a ditch,they were arrested and the car was towed.There is a police hold on the car, but once that is lifted tomarrow we are told we owe $233.00 to get it out. Can they hold the car if we can't pay? I know in arizona they had to release my car cause they can't by law hold property for money owed.

My suggestion is to settle the bill before it becomes any higher. If you have no interest in the vehicle the bill still needs to be paid and could go to collections if unpaid. Be proactive and retrieve the vehicle and file charges against the persons who stole the vehicle for reimbursement. If the vehicle was stolen most states have procedures for reimbursement from the state for arrested individuals but you must claim the vehicle. Most police departments can explain the procedures.
