Towing Issues: illegal tow?, rental lease agreement, small claims court

My vehicle was towed from my apartment complex for having expired vehicle registration tags. The stickers were expired but the vehicle is good to go in the system I just needed to receive the stickers which I never did. Even if the apartment complex had authorized the tow, the funny thing is the apartment complex just gave me different tags THAT DAY which allows me to park in the complex. And either way this is shady. My question is who should I come after here the tow company or the apartment complex when I go to small claims court? Or if you have any other advice I would appreciate it.

Well in all the classes I have taken covering towing and towing issues, this kind of issue comes up.  

Private property tow aways are the biggest problems in our industry as the tow company does generally require (by state laws which vary) written authorization to remove the vehicle.

And expired tags tend to be one of the biggest reasons for towing. That is generally addressed in your rental/lease agreement - contract.

Now since you did not mention what city or state this is in, I can not help with specific information as some locations have appeal processes and some do not.

Now as to small claims court and who to sue, well the person who authorized the tow, either in person or granting "patrol - cruise" rights to do the towing would be the best choice. But in the words of many lawyers...  

"SUE THEM ALL, Let the judge sort it out" is what I have heard suggested many times
