Towing Issues: Towing policies/safeguards, handicap cars, tow truck driver

I drove my husbands vehicle to the park yesterday. I recently had a child and my 2 year old was getting restless. We had several outstanding tickets (from a friend that we let borrow our old car) and the marshal had the car towed while we were at the park.  That being said, i'm not fighting the tickets or saying we shouldn;t pay the tow.  My question is - aren't there sageguards to prevent this? What I mean is - I had a newborn and a toddler and I was miles away from home in the cold (in the city close to night- not the safest elements) even if I had friends or family in the aren - the law prevents me from putting my children in a car without a carseat - which the tow truck did not allow me to take out.  Also, the jackets for the children as well as a necessary bottle and medicine were inside as well as a stroller but that's besides the point.  As you can tell I'm extremely angry - walking home in cold weather for over 3 miles with a 2 year old and an infant w/o his winter jacket (he did have a wind breaker on) could really cause them to get sick. Are there safeguards to prevent marshals from towing handicap cars due to tickets? How would they get home? As i said, I'm okay with the the fact we hadn't paid the tickets (do the crime pay the time) but couldn't they have booted the car instead or at least allowed me to recover some items from the car?

Well I really would like to help answer this question, but not sure where you are...

You mention the "marshals" having the vehicle removed and heard that they do that up in the New England area... Again am at a loss here for specific information.


Now as to your issue with them not letting you have the stuff inside the vehicle, it does sound like you did talk to the tow truck driver on scene... Not sure what happened there, but a lot of Cities do regulate what can happen on a police ordered tow... Or there could of been just a "bad apple" driver there.


Now as to walking home, well even if your vehicle has child seats or handicapped tags, the car does not "SPEAK" and say that you have kids or health issues CURRENTLY in the vehicle usage...

Its a big issue a lot of time and many complaints get filed about it with the police and courts... Hard to say what kind of resolutions that should be in place, again as it depends on the laws of the area involved.
