Towing Issues: broken frame??, small claims court, mobile home community

The mobile home community where I live had my car towed for expired plates. (only two weeks expired because my renew info went to my sisters old address). They did send my a notification that they would tow my car in 72 hours. I had ordered my sticker online and was waiting for it in the mail, but did not think to let the office know i done this. They had my car towed anyway, and as soon as I started to drive it off the lot, i noticed a clanging in the rear when i went over some bumps. I noticed it more and more on my way home. I also noticed tire marks in my driveway showing me they had "dragged" my car out. When i called the towing company back i asked if I should get an alignment, and they told me that it had been put on a flatbed, and that it was probably a rock in the brake. Well if it is a rock, it is a boulder! Anyway, I am taking it in for an estimate tomorrow, and I did take pictures of my driveway. I think I should take them to small claims court, but am not sure if it would be worth it. Do you think I have a case?

Well I seriously doubt that towing the vehicle "broke the frame"

There are all kinds of things which can go wrong when being towed, either with a wheel lift tow truck (where it picks it up by the wheels) or a flatbed where it is winched - dragged onto the truck bed.

A clanging noise can be like they say, a rock in the brake drum, a rock inside the hub cap, it can also be something loose like the exhaust which is hitting on the car body or any other number of things.
Its hard to provide an answer here since I can not see or inspect the vehicle.  Now you said that you were going to take it in for an estimate, well hopefully they will find the cause of the noise.

As to if the tow company did the damage or caused it, again it is hard to say without being there.  
I hope that the shop is able to tell you as to what is causing the issue and hopefully its not real bad or expensive to fix.


But you always do have the rights to take this to small claims court if you feel that you were wronged or anything like that.
I can not tell you if you really have a case or not though. Again the issue of me not seeing all the factors and issues comes back into play.
