Towing Issues: Handicap tags, rental management office, handicap placard

My mother lives in an apt complex and my sister doesn't reside there but is her caregiver therefore her handicap tag stays in my sister's car. By law can my sister's car be towed from there if she is in the apt taking care of my mother and has the handicap tag showing in the vehicle. She is having a problem with a tow truck driver that works for the owner of the apt complex and she doesn't understand whether or not by law he can tow her vehicle if she is inside caring for our mother. Can you give me any information on this?

A properly displayed handicap placard allows a vehicle to be parked in any PUBLIC handicap parking space. Since the apartment complex is not public parking and assuming the apartment complex is parking permit patrolled, your sister will also need a visitor's parking permit/pass when parking in a handicap parking space. If she doesn't have the handicap placard (properly displayed) she will be required to park in the visitor's parking spaces with the proper visitor's parking permit/pass.
