Towing Issues: Police Towing a Stolen Car and Stated on Incident Report Not to Tow, seattle police dept, auction fees

In Washington St., we recently had are car stolen and then was found and towed.  We made an incident report for stolen car and marked the box "Not to Tow the car By Renton Police who are part of King County.  The car was found by Seattle Police and also part of "King County" and was towed without calling us or advising that the car was found and recovered.  We received a call from the Renton police dept. that the car was towed and we asked why it was towed since we marked not to tow it and she told us that she did not know why.  She gave us the tow company number.  We explained the circumstances and they told us basically what ever and to pay anyhow and pick up your car or you will have to pay for more days of impound and possibly auction fees if the car is sold off.  Oh yes, the car was not involved in an accident and it was drivable as per the person at the Renton Police Dept.  
We payed to get the car out and are persuing a possible suit against the Seattle Police dept for negligence in not following up and calling us that the car was recovered before towing the car since the incident report states "NOT TO TOW".  

Is the Seattle Police dept. responsible for this and have to pay us back for the tow?

Do I have legal action in this matter against the police dept. and/or officer?

Also second note: There was a suspect and possibly two that was also caught.  If I can not get anything from the police on this, should I go after the suspects if convicted for this towing?

There is more to the story especially if there are suspects. Whatever the situation it really comes down to the arresting officer's discretion. If there is a ongoing investigation you will not know the whole story. There could be many reason's why the vehicle was towed even though you did not consent. Don't get upset at the police for doing their job or the towing company requested by the police. In many cases with a recovered stolen vehicle the tow company and or you can get reimbursed for the towing/storage expenses through the state, especially if someone was arrested for the theft. There are some guidelines that must be followed exactly and time is of the essence. Contact the auto theft division as they can give the proper procedures and forms for reimbursement.
