Towing Issues: towing drop fees, town magistrate, state statues


Question
Are drop-fees legal in AZ.? AZ. law says removing a vehicle when the vehicle owner is present or if the owner arrives at any time before the vehicle is removed from the property a fee cannot be assessed to the vehicle owner. However where i live it has happened several times costing anywhere from $100.00-$300.00 for what they call a drop fee.

I suggest contacting the state towing board website http://www.aptra.net/ Also check out http://law.justia.com/arizona/codes/title28/title28.html and scroll through all the content. This will take some time! Also, this link might be easier http://law.justia.com/arizona/codes/title9/00499-05.html but it doesn't say what the limits or fees are. It sounds as though the town, county or city regulates or sets the limit and fees not the state. I quickly scrolled and reviewed a few state statues but it never stated anything about towing fees or drop fees. This will require more research but not knowing the town, county or city you are working I am limited. My suggestion, visit your city, county or town magistrate, maybe they can help. Good question as it's definitely not in black and white. I am curious so let me know what you find.
