Towing Issues: tow that I refused in california, but was towed anyway, san bernardino county, tow company

I live in San Bernardino County in CA. I will try to make this short. I stopped to help and rollover victim. He was not hurt, I offered to call AAA and have them tow it for him, they dispatched a tow....In the mean time someone had called 911 and said that the car was on its side and would need a tow truck.--when the tow arrived I assumed it was the one I called from AAA. He would not even take my card and told me and the owner of the truck, he was dispatched by CHP, we did not have the right to refuse the tow. He did not listen when i told him CHP and AAA were on the way. The car WAS NOT in lanes or blocking lanes. The driver of the tow dispatched by CHP...told me since he was dispatched by the CHP we did not have the right to refuse the tow.
If the car is not blocking the lane, don't I have the right to refuse the tow. He charged us $220.00 to pull the truck out of the snow bank and upright it. When I asked him to wait for CHP he refused, took my $ (I paid with a credit card) and left. I know I should not paid him,but I did. What are the rights of a motorists when someone else calls 911 and a tow is dispatched by them. The driver of the tow (Cajon Towing) would not even talk with us about options, just pulled it out, when asked to wait he began an altercation with the owner of the rollover......

I'm not sure if you can or cannot refuse the tow. The driver was probably seeking commissions and misled you, but I can't be sure. I think you were trying to do the right thing and the driver should have waited for the chp. But I am not 100% sure. You should definitely call the owner of the tow company to discuss this
