Towing Issues: parking on public street, townhome community, chesterfield county

Question
I live in a townhome community in Chesterfield VA. Our streets are public. The HOA says we are not allowed to park on the street. They say the streets are only a cerrtain width and therefore the fire department prohibits parking on the street. There are not any "no parking signs" or markings on the road prohibiting parking. Can the HOA prohibit parking or have our car towed if we park on the street?

Answer
Hi Linda, without researching the Chesterfield County code or local ordinance, my first response is it could be prohibited if you have a contract or signed agreement with the HOA rules and regulations. Chesterfield County has such a rapid growth it seems the code changes daily! The county may have a agreement with the HOA and the HOA enforces the rules and regulations. The county administration office can verify the parking legality but as I said the HOA, in most cases, can take precedence. Hope this helps and any other questions feel free to ask.
