Towing Issues: Authority to Tow?, nancy nancy, certified mail

My brother-in-law used my vehicle with consent...got flat tire, called tow truck, used his debit card....car got fixed came back to house....towing company evidently called looking for him informing him that his debit card did not go through for towing, (I did not know)...towing truck came onto my property while I was not there and as a nonconsent tow, took vehicle...I had to go and pay for it and storage charge...is this legal...did they have to notice owner - if so, by certified mail? This is in Texas...do they have the right to do this? this cost me an additional $300 because of somebody else....thank you, nancy

It doesn't sound right to me. Trespassing is illegal of course. I would call the sheriffs non emergency phone and discuss this with them.

Non payment for services rendered is a matter that would have had to go to small claims I would think.
