Towing Issues: towed car with permit, wealthy property owners, tow truck company

my boyfriend lives in an apartment complex with extremely limited parking. when he got the apartment which was two weeks ago he was told if there is no parking park in front of your garage with a permit. so he did and later that night the car was towed. the tow truck company said the car was parked in a fire lane his garage is next to a trash can with a 2 and a half foot red curb separating the garage and dumpster.the car couldn't have been more than a few inches in front of the curb bc we made sure when we got out. is this legal fir the complex to tell us one thing and do another. my only concern is the lady that works for the complex didn't put that in writing, she just told him and his room mate it was allowed. what can i do?

Did they show you a picture? Most people who park in a fire lane are issued a ticket by the police. You didn't mention that, so I don't think you were in a fire lane, which then would and should have been a police tow. Go to the landlord, ask if she requested the car to be towed. If not ask her will she write a letter to the tow company stating the tow was not requested or simply make a phone call asking for your money to be returned.

At some point & time these wealthy property owners are going to have to get off their fat wallets and provide enough parking for the units they rent. One complex here, rents by the room, 4 to each unit,only one parking spot per unit. They hope only one has a vehicle, the rest ride the bus.....

You have been there for two weeks and already can see there is a BIG parking problem. If the complex manager won't help you with this tow-a-way, she's not going to be of any help in the future. In Tallahassee, we actually have laws that prevent a person in charge of a complex from taking 'kick-backs' from the tow-a-way companies. I'm sure this is not the only town that has this problem.

Did you happen to notice if all the vehicles parked where you pay to park had stickers on them? As far as the red curb, how much space is there? Enough for a firetruck? Look for a hydrant around the area.

AS A LAST RESORT:
If she will not stand behind her word, I'd see if she will refund all deposits, rent paid and for a moving truck. Try to get out while you can. Remember she has a boss she has to answers to. Ask other tenants if she has told them the same thing. If so, make a sheet for everyone she's told parking there is okay, get as many people as you can to sign. Present this to the actual owner of the complex. I can see being towed away from this complex as an on going problem.

FIRST:
First, try to work it out with her, the towing company wants to continue towing from this complex, it's Christmas time every time they go there, since the lack of parking is well known. She may be able to get them to refund your money with a simple phone call. Only if she is not willing to help, try the steps above. You don't want to be on her bad side right from the start! Yet you should be able to park when you arrive home, where you are paying the bills ~ Not wasting time & money at a tow-a-way lot!
