Towing Issues: Towed from appartment complex unrightfully and with damage, blacksburg virginia, smart alec

I live in a student appartment complex in Blacksburg, Virginia. My car was parked such that only the front bumper and maybe another foot of the car was crossing into the yellow-marked curb. Furthermore, the curb that is marked yellow was meant as an entrance for a new building that was never built, so technically it is not an entrance of any kind and there is a fixed fence. When I went to argue my case, the towing company was very impolite and would not hear me out, I even took a picture of my car the night I parked it, clearly showing how much I crossed the yellow line. Also, there is a noticable damage to my rear bumper and they are arguing it was already there. I have not paid nor picked up my car yet for these reasons, and am considering on calling the police and heading over with them. What should I do regarding these two matters?

Well I guess I can be a bit of a smart alec here, after all only part of your car was parked illegally, just like you barely had a accident or you were just barely were speeding in the school zone.

You did park with part of the vehicle in violation, should they of cut the offending part off and only removed the offending part.

I know the fact you think the tow company was impolite by not listening to your complaint and thoughts of how they should run their business, and how they respond to requests from the property owner - manager to remove vehicles which THEY FEEL are in violation.

NOW one question here, you state you took of picture of your vehicle that night when it was in violation.  WHY ?

Where you aware it would be towed, or where you just doing it for some other reason. I feel that there is something else to this whole issue

Now as to the damage, just have no answer to this other than it will be a he said, they say issue here. Sorry to say it but you have to talk to the tow company about it but it might not go the way you want.  

Now as to leaving the vehicle at the tow company, well each and everyday it stays there the fees go up. This is the storage part of the tow bill.  

But I can not tell you what to do, after all you are going to do what you need to do, and remember one thing. You always have the small claims court route which you can go after the apartment complex, the tow company and anyone else you feel cheated you in this matter.   

Oh yeah do not forget that the original problem was also one of violating a law be it the apartment complex policy, or a school policy, city law or state law...
