Towing Issues: my car was towed by a company not posted for our complex, tow companies, tow company

Question
I have an assigned parking and my mom's car was parked in my space.  My mom's was towed (she was visiting me for the weekend).  The company that towed was not posted or according to my HOA authorized to tow at my complex.  The tow company (Las Vegas, Nv) said they had a contract with my complex since 2005 (another company has signs on the property).  My Hoa is refusing my calls and the towing company said they did sign to have my mom's car towed.  what should I do?  Thanks

Answer
Well one of the common problems with towing from parking lots is the "he says, they said" issue...

In general, tow companies require that the property owner or manager be present to sign for the removal of the unauthorized vehicle. This is usually covered by State law.

Now another factor in your question is the signs and the different company. Some tow companies have several names they operate under and that might of been the case. But then there is also the possibility that the tow company sold out and the signs where just overlooked and did not get replaced or updated..

Now you mentioned assigned parking, is it by sticker or permit?   Your moms vehicle is an unknown vehicle most likely and that is why it got towed.

Plus the blame game of I did not order it towed, sounds like it is being played here.  I would keep on the HOA  but from the sounds of it, the tow sounds legal in the fact that your moms car was not the assigned vehicle for that space.

But the issue of the tow company problem is one that does sound like it bears looking into... I believe that the State of Nevada does regulate tow companies and they might be interested if not point you the right way in dealing with this...

But I do hope you got the vehicle out so that it is not getting more expensive each day.
