Towing Issues: Towing Legality, unlawful search and seizure, life liberty and the pursuit of happiness

Question
I live in Auburn, AL.  I have a question about the legality of towing.  Now i
understand that there are reasons that a city might need to tow a vehicle
which is illegally parked, but i do not understand how a private company is
not in violation of unlawful search and seizure according to the Constitution.
While this is a police power, without the consent of the owner of the vehicle
the car is effectively stolen from that citizen, and depriving them of the
pursuit of life, liberty and the pursuit of happiness (which was originally
defined by the writers of the Constitution as the pursuit of property).  Have
there been court cases that prove the legality of this practice?  I would not
mind so much if the city itself was towing vehicles, but when it becomes a
privatized commercial business, i question the ethics and morality of that
business.

Answer
Oh my,  I am going to have to pass on this issue as it does sound like a good argument in court, but you ask if the tow company can legally tow vehicles from Private Property..
Well the reason is also a legal one, where the vehicle has trespassed upon the property owners rights.

What about the person that owns the property, are there legal rights which are violated regarding the unlawful trespassing upon private property. Is there something that covers that issue...

Now I am not a lawyer so I can not answer the legality of this issue, I am just a tow truck driver who volunteers on this board to answer towing issues, and tows vehicles when called by the property owner or the police.
