Towing Issues: towing question, towing company, typical problems

My brother had a ticket a while ago, and his license was suspended for some time because he didn't pay for it. But then everything was taken care of. Couple of days ago someone broke into my brother's tow truck and stole his GPS. My brother called the police to report that, they asked for his license # and in their records it still showed as his license is still suspended. So, instead of coming out and inspecting his damaged truck, they arrested him and put him in jail. They towed his truck away and charged him $700 to get it back, and I had to pay $320 to bail him out. And when he was getting his truck back from the towing company, they gave him his license back. So, if his license was really suspended, they wouldn't give it back to him, right? So, they had no right to arrest him and tow his truck away. What are my options? And my brother's options?

I am going to say that this sounds a bit like the typical problems with licenses and suspensions..  It does take some time to get things corrected with DMV, the Police and the Courts...  As such with all the different agencies involved I have seen this happen before..

BUT my best advise is to contact a lawyer about this and see what they say can be done as they have handled this kind of problem before
