Towing Issues: Towed from Appartment, dmv website, california dmv

QUESTION: (Highland Ca.)My car was towed from my assigned parking space at my apartment complex, it was registered , insured , in running condition and had the parking sticker/# displayed from the rearview mirror(as required).I was not notified of the removal of my car , until 10 days later when The mail I received a Lien Sale notice, the car was taken over 30 miles away. police will not help What can I do ??

ANSWER: OK, let me get this straight...

You have a licensed, insured, running vehicle in your space and it was towed away... What was the reason given to you for the tow ???

Also, you did not notice it was gone for 10 days??? come on now, were you out of town?  
Were they doing construction, paving, painting or what??

As to the real rules, I would suggest you check out the California DMV website and read the rules for removal from private property..  I might be wrong but when they changed the rules at the first of the year, they did have something about a 10 mile radius of where the vehicle was parked at to the tow company (I know that does not work in some areas) but that was in the proposed rules I read...


Check with the DMV  and look at 22658 which is the section you want...

They might also be able to help you with this and guide you to correct answers ... Or help you resolve the issues which were illegal if any...

QUESTION: Thank you for your reply. The reason(s) for the tow that where given are abandoned vehicle/expired registration,
which are false.also the name on the authorizing signature of the complex manager does not match the name of the actual manager . I have read vc22658 and the code states if the tow company has special permission from the local police,they can tow anywhere. To me it seams that many provisions of code "22658" were violated . But what can you do when the police refuse to investigate or even take a report of a illegal activity , sure you can go to small claims court, and in the mean time your car gets lien sold

Well, it does sound to me as if the towing company did have a few problems, but some of them might be legit with the distance and the notification of Lien sale..

Now in the other follow up you mentioned that it was a vehicle you do not use much which was towed...   How many spaces are you allowed for vehicles in your apartment complex... That might of been a problem as I see it...  If vehicles are not moved or used then they do collect dust, have weeds and stuff grow around them, leaves collect under them.. They do appear to be abandoned then.. Also secondary vehicles do tend to have other issues...
Such as registrations among other things..

The signature, well that might be an issue, but most likely for court...

Now as to how to resolve the issue... PAY THE FEES get the car out.. Go to court then, as it will be cheaper and you will have the vehicle incase you lose... If you win then you will get some money back... At least that is the best advise I can give you.. Remember that the towing fee is just that,  the fee to TOW the vehicle... Daily storage fees, and fees for legal paperwork such as the lien letters also add to the fees owed on the vehicle..
