Towing Issues: I am not the title owner; but was listed as a registered owner, letter in the mail, storage fees

I had a truck that was a piece of crap; I had claimed bankruptcy and my truck was listed on that bankruptcy. I stopped paying on the truck; cause the truck didn't run; I informed the title owner/finance compamy bank one, that I was no longer going to pay on it, and they advised they would reposes it. The truck one day disapeared, I guessed they repossessed it, and almost 1 year later I got a letter in the mail from a towing company that said I owe $1,700 in storage fees. They are now sending me to collections. I don't have the title to the truck, the bank does; it was included in my bankruptcy; do I owe the towing fees; or does bank one owe the towing fees? I don't want the truck; they can keep it for all I care; but they are not stating that they will add this to my credit report; which I have a pretty good credit report and don't want them to tarnish it. Do I owe the money? and If I do pay it, am I entitled to the title?

Wow, you have touched an area where I can not give a solid answer for you..

Bankruptcy has some special rules, and of course your attorney should be able to answer it.
The towing company is entitled to payment for towing and storage fees in most areas according to law. In some areas the legal owner is not responsible for towing and storage fees though....All depends on the laws of the state you are in.

But this question also makes we wonder if your vehicle was towed for being abandoned or parked illegally... I think you should of checked and seen if it was repo'ed by the bank or finance company after it disappeared.   That seems to me to be a mistake on your part..

As to if you owe the money, I would say that something needs to be worked out, as you still appear to be the owner... Yes a lot of towing companies do use collection services to get the money that is due them according to state law.
Best answer is to contact your lawyer and see what remedy is available for you since the bankruptcy was involved .
