Towing Issues: Possible illegal tow and Car damage., small claims court, apartment owner

Hi, I'm a resident of Huntsville, Alabama.  On a recent trip to Florida for a week I parked my car at a friends apartment complex in Auburn, AL and he drove the rest of the way to Florida.  

A week later when I came back to the Auburn apartments I found out that my car had been towed from a neighbor by the owners of the apartment complex. I was given the runaround and consequently had to stay in the town for another day before I found the company that had my vehicle.  

And then the inconsistencies began.  The company that towed my car kept claiming that they did not or weren't authorized to tow cars from apartments and illegal parked areas and that they only towed wrecked cars in accidents.

They claimed that the owner of the apartments was a friend of the owner of the towing company and had called in a personal favor. They said the apartment owner said my car had been sitting out there for 6 weeks and that's why it needed to be towed.

When I recieved my car the right side of the brush guard was hanging down.  While it was loose before, it had still been attached.

Do I have any recourse or am I just out of luck?

well this sounds like something is up....  If your vehicle was damaged while towing , then yes you have a claim.  

But its one of those hard to prove cases usually.  Specially with pre existing damage to the vehicle in that area..

It does sound like you are getting a run around.  First not saying they do the tows from private property, then claiming it was there for 6 weeks.   

Best bet is if there is no responce or actions on the damage, or if you just plain feel that is was towed illegally  you can go the Small Claims Court route.
But it would have to be in the city of Auburn which would mean trips and time off.  Depending on the costs you incured it might not be worth it.  But that is up to you to decide.
