Towing Issues: towed a car I sold., motor vehicles department, return receipt

Question
Richard,

Last week I recieved a letter from a collection agency saying I owe $800 to Deitz towing in CA. I had no idea what for. I spoke with and they told me it was for a car I had sold to a private party in 1997; nine years ago! Apparently, the private party did not register the car in their name to the DMV. This March 2006, they decide to leave it in the street....then let it get towed by police order.

I don't think I filled out a release of liability to form to the DMV in 1997.

Deitz towing kept the car in their lot for about 2 months....racked up a bill to $1400. Then auctioned it off for $600.....sticking me with difference of $800 for a car I SOLD 9 years ago!

They told me that in March 06, they sent me a notification but I did NOT recieve one. The first I'm hearing about this is through the collection angency.
Please help. What can I do????

Answer
First I would contact the California Motor Vehicles department, and see what they say about the vehicle and the sale of it.  They might have some sort of paperwork or something that should show you do not own it.  I find it hard to beleive that in 9 years  no one registered it, or avoided any contact with any law enforcement.

I would also explain to the collection agency this in a letter sent certified return receipt requested.

To bad you do not remember who you sold the vehicle to. It could help alot.

Not sure what to say, but I hope that it works out for you.
