Driving & Driving Test Tips: CVC on merging and right of way, reckless manner, lane 1


Question
I was in the #1 lane (of two) when the #2 lane narrowed and merged with lane #1. A box truck immediately to my right in the #2 lane, having almost run out of road, started to move into my lane trying to intimidate me with his much larger vehicle and trying to force his way into the lane in a reckless manner. He contacted the mirror of my 2005 Ford pick up and damaged it beyond repair. At this point I did brake and he zoomed in front of me. All this while he was chatting on a cell phone. His insurance "found" that I was 20% to blame because I "did nothing" to prevent the incident. (in other words not yielding to him!) I'm not buyin' it! Could you cite the section of CVC that applies?

21658(a) CVC  the other insurance company is saying you are at fault so that they don't have to pay for the damages and hope you will go away.  Don't let them intimidate you, let your insurance company handle it if you have comprehensive, if not do not take anything less then full and complete repairs for your vehicle.
