My son was involved in an accident where he was hit in the passenger side door and pushed through the intersection turning the car 90 degrees. The officer ticked my son only on the basis that he asked my son at the scene who had the right of way and my son said " I don't know i guess she did since she was on the right and i waited for her to go but she just sat there".

I was told by the officer at the seen that the other car (97 olds acheiva) was at a complete stop and that my son also stopped but went out of turn and so that was the reason for the ticket.

I am concerned that this is not all of the information since there was HEAVY damage to my son's 1990 Camero RS. He was hit square in the door, no damage to the front or the rear, outside of the tires, just between the tires centered on the door with what appears to be significant damage to the door post at the hinges, possible twisted frame? At the point of this impact my son was probably 75% through the intersection. Not to mention that his car was pushed 20-30 feet and spun at a 90 degree angle from original direction of travel.

Two questions,
1. Would it be worth my time to fight the ticket?

2. Would it be worth my time to get a reconstruction and would it make any difference?  

Answer
you can fight the ticket by argueing that your son waited a reasonable amount of time before proceeding forward, but his own statement may sink your case.  it depends on how long your son waited.

i don't know that a recon could help in this case in that your son indicates that the other driver had been stopped and he had waited for her prior to the collision.
