Driving & Driving Test Tips: backing out of a parking spot, mitigating circumstances, definitive answer

My daughter was backing out of a parking spot and hit a car which was going to quickly through the parking , rushing carelessly trying to get by.  Whos is at fault?

if it is private property there aare no vehicle codes that cover this,but usually the person backing up is supposed to do so safely, but there may be mitigating circumstances, such as, the other car could not have been seen when you first start ot back up and they shold have been using better caution.  your circumstances do not allow a definitive answer.
