Driving & Driving Test Tips: Is this worth fighting or just pay the ticket?, other vehicles, first mistake

I was on my way home and a police was pulled over on the side of the road, as I am a teenager he pulls out and follows me for a good five minutes looking for the first mistake I make. It was around 7:45 pm with very light traffic, one car ahead of me and the police behind me and no one coming from behind me to the lane I wanted to get to. So I made my lane change to my right without signaling not noticing my mistake, but did signal I was taking that right. I get pulled over get a ticket. I am not sure if this will help my case but then I notice the policeman does the same thing I do, does not signal changing lanes. Is this fightable

This ticket is a matter of how much time you are willing to take to fight it.  

First, what section did he cite you for, if this is a California case.

Second, if this is a moving violation in your state, then you can check to see if it can be expunged if you take traffic school without having to fight the ticket.  This would cost you the fees for the school and a day at the traffic school.  If not, or you don't want to take the school, then you can fight it.

You first have to take time to go to the court and post bail to have your case heard.  Then take time to go to court for the hearing.

If you take it to court, then you should ask the officer if there was any traffic that was impeded by your lane change.  Hopefully there wasn't any.  Then ask him if lane change had an impact on any other vehicles in the area that you made your lane change.  Hopefully there wasn't any.  Then ask him if there would have been any impact from the use of a signal to make your lane change.  Hopefully not.  Then ask him if the lane change was made in a safe manner such that no other traffic was influenced by your lane change.  Hopefully not.  Then ask him if he has ever made a lane change without signalling.  Hopefully he will be honest and say yes (hopefully the judge will remember some instance of making a lane change without a signal also, but don't ask him that).

Then argue that you had properly checked traffic prior to making a lane change and did not see any traffic that would be impeded by your lane change.  Emphasis that you made a safe lane change (assuming the officer said you did when you asked him about your lane change) to approach to make a right turn and applied your signal to make the right turn.  Then state that since there wasn't any traffic that was influenced by your lane change, and it was made in a safe manner, the use of a signal would not have made any difference in the course of your lane change.  Therefore in the spirit of the law rather then the letter of the law you should be found not guilty for this violation.

Thrid, if this isn't a moving violation, it might be easier to pay the ticket rather then taking the time to fight it.
