Question
Hello, I don't know if you would know anything about this but I got my license suspended twice within a one year period. I want to get my occupational license but it says I am not eligible? It says I can go to the courts to become elgible but I think it says that I will still be ineligible even if I do go to court and get it accepted? Any ideas on this?? I'm very confused.

Firstly, it really depends on who suspended your license, whether it was the DOT/DMV or the courts,

If the courts had ordered the suspension, you can always ask them to re-evaluate the case based on mitigating circumstances, or request a limited license for work related purposes. The judge usually has a wide margin of discretion in this area.

If the DOT/DMV had ordered the suspension, the courts cannot change this as it occurred outside of their domain.

If this is the case, you can request a hearing with the DOT/DMV, requesting them to re-evaluate your suspension, however, their administrative codes are very hard-lined, structured and strict. They usually have an extremely narrow margin of discretion within their application.

The bottom line is, not everyone has the option to reinstate their driving privileges, which can be suspended anywhere from 30 days to an indefinite period.

Sometimes a qualification is also attached to reinstatement such as, a Negligent Operator Program, DUI Treatment Program, Anger Management Program, Physicians Recommendation for health issues, completion of a probationary period and the like.

The above information is very vague as I have no idea why your license was suspended this time, the time before, what your drivers record looks like and what orders the court and/or the DOT/DMV placed upon you. I also have no idea what state this occurred in.

You may even need to consult with an attorney depending on which of my speculations are correct.
