Tips on Buying Cars: used car buying, legal recourses, moderate damage

Question
I purchased and signed a contract on a used car that had a clean carfax stuctural report, but one moderate damage accident.  Dealer had said it had no accidents.  I ordered an acutal accident report from the police department which indicated significant damage.  I have not taken possession of the car and want a refund?  Dealer is stalling, making excuses and has already cashed the check.  What are my legal recourses to get $$ back as soon as possible?

Answer
Jenifer,

Thanks for your question.  You are not the legal owner of that car until you take possession of the vehicle.  You are entitled to every penny of your money back that they have in their possession.  Do not let them tell you any differently.  In EVERY state you are not the legal owner of the vehicle until you take obsession.  Simply threaten to take them to court, and that should remedy the situation.  Call the dealership and ask to directly speak to the General Manager.  Explain the situation and what you will do in the event that they don't refund you your money back.  They know that they have no recourse against you, but they will try to scare you into the fact that they do.

Hope this helps.

Thanks - JB
