Tips on Buying Cars: Paint Problems, side fender, swirl marks

I bought a 2009 BMW 328i X-drive sedan last monday. When I got it home I
realized there was a dent in the front drivers side fender. I called the
dealership an they agreed to fix it and were very apologetic. When I Received
the car again I could still see where it was as they only popped the dent out.
They Said it was a difference in the paints orange peel and that it would need
to be buffed. I brought in in a couple days later to be buffed out and the re-
detailed the whole car Leaving Huge Deep Swirl Marks On My cars black
metallic paint. The finish looked mat. It is now being re-detailed again by
their body shop. Should I just ask for a new car? What are the repercussions
of all this wet sanding?  Will the swirls come back? What should I do?

How would the swirls come back?  I've never in 25 years had someone ask such a question.  Swirls do not come back.  They are not like a malignancy.

You've stated that they are going over the car again.  Therefore, I'm not sure why we are addressing any other scenarios such as asking for a new car.  

My additional thoughts are that if this much of your attention and energy are being devoted to a perfect black finish on your brand new BMW, then you are living in a much different world than the rest of us.   

Black cars are perfect up to the point of the factory completion.  After that, they will remain the stepchildren of every local detail shop in an fruitless attempt to keep them looking decent.  Black is the absolute lack of any light reflection.  Therefore, there is nothing left for the eye to focus on other than imperfection.  You may want to discuss this with your therapist.

If you are particular and it it clear that you are, then I'd suggest something like silver next time around.
